These terms are in two parts.

Part A — General Terms apply to every Bearing programme.

Part B — Programme Schedules set out the detail of each individual programme. Schedule 1 covers UK Ready.

Where a Schedule and Part A conflict, the Schedule takes precedence for that programme.

PART A — GENERAL TERMS

1. About these terms

These terms form the contract between you and Bearing Safety & Security Limited when you book a place on any Bearing programme.

Bearing / we / us — Bearing Safety & Security Limited, company number 17354268, registered office 124 City Road, London EC1V 2NX
You / the Purchaser — the person or organisation booking and paying. Usually a parent or guardian, or a university, college, employer or education agent
The Attendee — the person taking part in the programme. Referred to as the Student where the programme is delivered to students
The Programme — the Bearing programme booked, as described in the relevant Schedule
A Cohort — a single delivery group, with its own date, venue and attendee list
The Institution — a university, college, education provider or other organisation arranging a Cohort
The Schedule — Part B of these terms, for the Programme booked

Where the Purchaser and the Attendee are different people, the contract is with the Purchaser. The Attendee is not a party to it. Nothing in these terms gives any other person a right to enforce them under the Contracts (Rights of Third Parties) Act 1999.

2. Booking and payment

Individual bookings. Payment is due in full at the point of booking. The booking is confirmed, and access to any pre-course content is released, once payment has cleared.

Institutional bookings. Cohorts are confirmed by written agreement and invoiced. Payment is due within 30 days of the invoice date. Access to pre-course content is released on confirmation of the booking.

Prices are as published at the time of booking, in pounds sterling, and include VAT where applicable. Payments are processed by Stripe. We do not hold card details.

A place is confirmed only when we have issued written confirmation. A place is not transferable to another Attendee without our written agreement.

3. Your right to cancel — first 14 days

If you are an individual buying for your own use, or for someone in your care, you have a legal right to cancel within 14 days of booking and receive a full refund, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

Where a Programme includes digital content delivered immediately, and you want access inside that 14-day period, you must ask us to start it and acknowledge that doing so ends your right to a full refund. If you do not, access begins once the 14 days have passed.

To cancel, email contact@bearinguk.com. Refunds are made to the original payment method within 14 days of us receiving your notice.

4. Cancellation, transfer and rescheduling

Cancellation and transfer terms, and the notice periods that apply, are set out in the Schedule for the Programme booked.

Cancellation by us. We may cancel or reschedule a Cohort where the minimum number of Attendees set out in the Schedule is not reached, where a facilitator is unavailable and cannot be replaced, where the venue becomes unavailable, or where circumstances beyond our reasonable control prevent safe delivery.

Where we cancel, you choose between a transfer to another Cohort or a full refund. We tell you as soon as we know.

We are not liable for travel, accommodation or other costs you incur in connection with a cancelled Cohort.

5. Health and medical disclosure

Disclosure of relevant health information is a condition of attending any Bearing programme involving physical content or emergency first aid. It covers medical conditions, allergies, medication, injuries, disabilities, accessibility requirements and dietary needs.

We use it to deliver safely and to respond correctly if an Attendee becomes unwell. It is handled as set out in our Privacy Policy.

Where a condition is not disclosed and comes to light on the day, we may exclude the Attendee from the physical elements. Where a disclosed condition means the physical elements are not safe, we adapt them where we can and, where we cannot, the Attendee completes the remainder of the day and receives a record of what was completed.

No Bearing programme is a medical assessment and we give no medical advice. If you are unsure whether the Attendee is fit to take part, take advice from a doctor before booking.

6. Attendees under 18

Where the Attendee is under 18 at the date of delivery:

The booking must be made by a parent, guardian or Institution
Written parental or guardian consent is required before attendance, covering the physical content, any off-site activity, emergency treatment and health information
Where a UK guardian arrangement is in place, guardian contact details are provided alongside the parent's
Arrival and departure arrangements are confirmed in advance. We do not leave an Attendee under 18 unaccompanied at the venue
Any completion report is issued to the Purchaser

7. Conduct

Attendees are expected to take part with respect for the facilitators and the other Attendees, follow safety instructions, and remain with their group during any off-site activity.

We may remove an Attendee from delivery, without refund, where their behaviour puts themselves or others at risk, where they are under the influence of alcohol or drugs, or where they refuse to follow a safety instruction.

Where an Attendee is removed, we inform the Purchaser and, for an institutional booking, the Institution, the same day. Where the Attendee is under 18, we inform the parent or guardian and do not leave them unaccompanied.

8. Photography and recording

We may photograph or film during delivery, for training and promotional use, only where consent has been recorded. Consent is optional, is never a condition of attending, and may be withdrawn at any time by emailing contact@bearinguk.com.

Attendees may not photograph, film or record the programme content, the facilitators, or other Attendees.

9. Certification

Where a Programme includes certification, the conditions for issue are set out in the Schedule.

A Bearing certificate records completion of a Bearing programme. Unless the Schedule states otherwise, it is not a regulated qualification, a licence, or a first aid certificate for workplace purposes, and it does not qualify the holder to act as a first aider or security professional.

Where a Programme is described as designed to CPD accreditation standards with accreditation in progress, we do not claim accreditation that has not been issued.

10. Our materials

All programme content, including online modules, workbooks, handouts, templates and assessment material, belongs to Bearing.

You and the Attendee may use them for personal learning. They may not be copied, shared, published, resold or used to deliver training to anyone else.

11. Liability and insurance

Bearing holds public liability and professional indemnity insurance. Certificates are available to any Purchaser or Institution on request.

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.

Subject to that:

We are not liable for indirect or consequential loss
We are not liable for loss or damage to an Attendee's personal property at the venue
Our total liability in connection with a booking is limited to the fee paid for that booking
We are not liable for the acts or omissions of an Institution, a venue provider, or any third party

Bearing programmes teach personal safety. They reduce risk. They cannot eliminate it, and we give no assurance about an Attendee's safety outside the delivery of the Programme.

If you are booking as a business or an Institution rather than as a consumer, the Consumer Rights Act 2015 does not apply to your booking.

12. Force majeure

Neither party is in breach of these terms where performance is prevented by something beyond reasonable control, including severe weather, transport failure, public health restrictions, or the loss of a venue at short notice. Where that happens we reschedule, and where rescheduling is not possible we refund in full.

13. Changes

We may make minor changes to programme content, session order, venue, facilitators or timings. We will tell you where a change is significant, and where a significant change does not work for you, you may transfer or take a full refund.

We may update these terms. The terms that apply to your booking are the ones published when you booked.

14. Complaints

Tell us. Email contact@bearinguk.com. We acknowledge within five working days and respond in full within twenty working days.

If you are not satisfied with our response, nothing in these terms affects your statutory rights or your right to take the matter further.

15. Data protection and safeguarding

Personal information is handled as set out in our Privacy Policy. Safeguarding is handled as set out in our Safeguarding Policy. Both are available at bearinguk.com, download it.

Our full safeguarding policy, incident reporting and escalation procedure, route risk assessments, insurance certificates and facilitator qualification records are available to partner Institutions on request.

16. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you live outside England and Wales, this does not remove any protection you have under the law of your own country.

PART B — PROGRAMME SCHEDULES

Schedule 1 — UK Ready

A two-phase personal safety and security programme for international students arriving in the UK to study.

S1.1 What the Programme includes

Phase 1 — Online foundation. Ten online modules, around two hours of video, self- paced, with a knowledge check on each module. Completed before the Student arrives in the UK. Closes with a personal safety plan submitted for review.

Phase 2 — Practical day. Six in-person sessions, seven hours of content, delivered in the UK within the Student's first two weeks of arrival. Covers situational awareness including a supervised off-site exercise; avoidance, de-escalation and escape taught as a decision framework; a dedicated mental health first aid session; and hands-on emergency first aid including CPR, AED use and anaphylaxis. Closes with live scenarios.

UK Ready does not teach physical restraint, self-defence techniques or contact drills.

On completion. A named UK Ready certificate, and a completion report issued to the Purchaser.

Delivery runs approximately eight hours fifteen minutes including breaks. Times are confirmed with the Purchaser and Institution before the day.

S1.2 Delivery standard

Every Cohort is delivered by two facilitators. Both hold an enhanced DBS check including the children's barred list, Level 2 safeguarding training in both children and adults, and a current first aid qualification.

The Lead Facilitator additionally holds a teaching qualification at Level 3 or above in Education and Training, the Level 3 Award in the Delivery of Conflict Management Training, First Response Emergency Care Level 3 or above, and the Level 3 Award in Supervising First Aid for Mental Health.

The conflict avoidance and de-escalation session, the first aid for mental health session, and the emergency first aid session are delivered by the Lead Facilitator. No student group is supervised by a single adult at any point.

S1.3 Cohort size

Maximum sixteen Students. Minimum eight.

Where fewer than eight Students are confirmed, we may cancel or reschedule under clause 4. Where the reason is cohort size, we will tell you no later than seven days before the practical day.

S1.4 Cancellation and transfer by you

After the statutory 14-day period at clause 3, and calculated from the date of the practical day:

A transfer may be requested once. A place transferred and then missed is forfeited.

Non-attendance on the day, without notice, is treated as a cancellation inside 21 days.

S1.5 Visa refusal and delayed arrival

If the Student's UK visa application is refused, we refund the fee in full at any point, on sight of the refusal notice. This applies regardless of how close to the practical day the refusal is issued.

If the Student's arrival in the UK is delayed, we transfer the place to the next available Cohort at no charge.

If no suitable Cohort is available within four months of the original date, you may take a full refund instead.

S1.6 Completing Phase 1

Completion of the online modules is a condition of attending the practical day. The practical content builds directly on them, and a Student who has not completed cannot take part safely.

Where a Student has not completed Phase 1 by the date we confirm the Cohort list, we offer one transfer to a later Cohort. If Phase 1 is not completed before that Cohort, the place is forfeited and no refund is due.

We tell the Purchaser in writing before a place is forfeited on this basis.

S1.7 Institutional bookings

Where an Institution books a Cohort, the following also apply.

Venue. Where the Institution supplies the venue, it must be suitable for the physical content, private, and available for the full delivery window. We confirm suitability in advance and may decline a venue on safety grounds.

Supervision. Bearing supplies both facilitators for every Cohort. The Institution is not required to provide staff cover, and no additional charge arises for supervision. Where the Institution wishes to place a member of its own staff in the room, it is welcome to do so.

Student data. The Institution provides Student names, dates of birth, contact details, emergency contacts and health disclosures no later than seven days before the practical day. We cannot deliver safely without them.

S1.8 Certification

A named UK Ready certificate is issued to a Student who completes both phases, including all Phase 1 knowledge checks and attendance for the full practical day.

UK Ready is designed to CPD accreditation standards, with accreditation in progress. Clause 9 applies.
